The Galerie d’art Au P’tit Bonheur, referred to in this policy as “the Gallery,” operates the site auptitbonheur.com. The Gallery is committed to making your online shopping experience pleasant, simple and efficient.

The Gallery requests that you read this online purchasing policy carefully. By making an online purchase, you acknowledge that you have read and understood this purchasing policy and the website’s terms and conditions. You also agree to abide by them, as well as any amendments made to them.

 

Online orders

You can view more than 700 original artworks, paintings and sculptures on auptitbonheur.com and read about each piece before adding it to your shopping cart. When you click on a thumbnail on an artist’s page, an enlarged image and detailed description will be displayed. If you wish to purchase a piece of art, simply click on the “Buy” button at the bottom of the enlarged image. The piece will then automatically be transferred to your shopping cart. The contents of your shopping cart can be viewed at any time by clicking on the shopping cart icon in the upper right-hand corner of the screen. The contents of the shopping cart can be modified at any time. In particular, you can remove items you no longer wish to purchase by clicking on the garbage can icon next to the item description.

Only original works, paintings and sculptures can be purchased online. If you wish to purchase reproductions, please contact the Gallery’s bilingual customer service by phone at 1-855-665-2060 (toll-free) or by email at info@auptitbonheur.com.

 

Once you have finished shopping online and checked your shopping cart, simply click on “Pay” and fill in your billing, mailing and payment information. A summary of the transaction will then appear on the screen, including a description of the items ordered, the purchase price of each item and any applicable taxes.

 

Checking the order

You can check and change the shopping cart, billing, delivery and payment information as many times as you wish before clicking on “Place Order,” which will finalize your purchase. Once the transaction is finalized, the total amount of the order will be automatically charged to your card.

Please note that finalized orders cannot be cancelled or changed online. Order confirmation and acceptance

When you place an order on auptitbonheur.com (by clicking on “Place Order”), you will receive an automated email stating that the Gallery has received your order. This order confirmation email will be sent to the email address you provided during the purchase within 10 minutes of placing the order. The email confirms payment, but is not an invoice. The order constitutes an offer to the Gallery to purchase the items indicated in the order confirmation, at the price and subject to the terms and conditions described in the confirmation. The Gallery is not bound by orders until it has accepted them.

The Gallery will indicate that it has accepted the order by sending a second email to the email address you provided. This email will be sent within one business day of the order. It will include the official invoice in PDF format, the digital photo of the piece(s) purchased, and information about shipping. Please note that a physical copy of these documents will be provided in an envelope attached to the package.

Invalid transaction

As the items shown on auptitbonheur.com are limited by nature, the original works will be offered and visible on their creator’s pages until they are sold. However, pieces are not removed from users’ shopping carts once sold. A piece may remain in a shopping cart even if it is no longer available. If you attempt to purchase a piece that is no longer available, you will see the message “Certains items figurant dans votre panier ne sont plus disponibles / Some items in your cart are invalid” after you click on “Place order.” If this occurs, please contact the Gallery’s bilingual customer service by phone at 1-855-665-2060 (toll-free) or by email at info@auptitbonheur. com as soon as possible.

 

Payment

 

Currency

All prices are in Canadian dollars and all orders are processed in Canadian dollars.

 

Applicable taxes

Prices displayed on the website do not include sales taxes (if applicable).

 

The gallery levies sales tax on items ordered through its website. The sales tax on an order depends on that order's mailing address. The federal Goods and Services Tax (5% GST) and the Québec Sales Tax (9.975% QST) apply to works shipped to Québec. Only the federal Goods and Services Tax (5% GST) applies to works shipped to Alberta. The harmonized sales tax applies to the following provinces: Ontario (13%), Nova Scotia (15%), Prince Edward Island (15%), New Brunswick (15%), Newfoundland and Labrador (15%). The federal Goods and Services Tax (5% GST) and provincial sales tax apply to works shipped to British Columbia (7% PST), Manitoba (7% PST) and Saskatchewan (6% PST).

 

Online Pricing Policy

The prices listed on auptitbonheur.com are identical to the prices shown in the gallery. No administration or shipping fees are added to online transactions. In the event of a discrepancy between the information shown on this website and the information shown in the gallery, the information in the gallery takes precedence.

 

Accepted payment methods

Purchases made through auptitbonheur.com can only be paid using Visa or MasterCard credit cards.

 

We do not currently accept online payments by PayPal, American Express, debit card, gift certificate or eTransfer. However, American Express credit cards and eTransfers are accepted for transactions made over the phone or in the gallery. Debit cards and gift certificates can also be used in the gallery at any time. Online payment

All purchases made through auptitbonheur.com must be paid in full; the total amount of the order will be charged once the order is placed on the website.

 

Instalment purchases without fees or interest

The Gallery’s Courtesy Service allows customers to spread payments for gallery or phone purchases over a set period (6, 12, 24, 36, 48 months or more) without fees or interest.

 

Example payment terms

For a $3,600 CAD purchase, payments can be made in:

6 installments of $600/month;

12 installments of $300/month;

24 installments of $150/month;

36 installments of $100/month or other, depending on the agreements made.

Payments are made by monthly withdrawals from a MasterCard, Visa or American Express credit card. The item will be shipped immediately.

 

Auptitbonheur.com does not allow instalment purchases to be made online. Official invoice

If you make an online purchase through aupetitbonheur.com, you will receive an email with the official invoice in PDF format, the digital photo of the piece(s) purchased and information about shipping. Certificate of authenticity

Each original work of art sold by the Gallery comes with a signed and completed certificate of authenticity in an envelope attached to the package or the back of the canvas.

 

Credit card registration and data storage

For online purchases made through its site, the Gallery collects only the personal information needed to process current and future orders. Users’ credit card numbers and the personal information needed for online payment are only shared with the external provider responsible for processing online transactions. As a security measure, the Gallery does not store any credit card numbers provided as part of an online transaction through the website. Only the last four digits of the credit card will be shown in the order confirmation email to allow you to quickly identify the card. Shipping

 

A valid mailing address must be provided at the time of purchase. Items cannot be shipped to P.O. boxes.

 

Free shipping within Canada

The Gallery has more than 30 years of experience in shipping works of art. This service is free of charge for paintings and sculptures shipped within Canada*.

* Some restrictions apply to certain remote areas, including Nunavut, Yukon and the Northwest Territories. Customers from these regions are invited to contact the Gallery’s bilingual customer service by phone at 1-855-665-2060 (toll-free) or by email at info@auptitbonheur.com.

 

International shipments

Products purchased through the site may only be sold and distributed to customers in Canada; auptitbonheur.com does not allow online shopping for customers outside of Canada. However, if you live outside of Canada and wish to purchase a piece, you may contact the Gallery’s bilingual customer service by phone at 1-855-665-2060 (toll-free) or by email at info@auptitbonheur.com. Orders placed from outside of Canada, including the United States, are not subject to the Canadian federal goods and services tax, provincial sales taxes or other Canadian taxes and duties on product orders. For items being sent outside of Canada, shipping costs are based on the destination, weight, size and value of the piece(s). They include any taxes and customs duties that may be imposed by the authorities of the country of destination.

 

Packaging and handling

The Gallery offers free packaging and handling for purchases. Its skilled employees do everything possible to ensure that the parcels reach their destination in perfect condition. Shipments are highly secure and carefully packed in high-density, triple-layer cardboard boxes.

 

Multiple mailing addresses

Online orders are shipped via courier companies (Purolator or UPS) or Canada Post and can be shipped anywhere in Canada. The Gallery reserves the right to choose the best shipping service for the parcel’s size, weight and destination. Shipping services

Delivery time

Online orders are processed for shipping once the information provided has been verified. Orders placed outside of business hours will be processed the next business day. Delivery times vary according to the destination. Deliveries are generally made within one (1) to nine (9) business days (Monday to Friday, excluding public holidays). Please allow up to fifteen (15) business days for delivery to remote locations.

 

Deliveries are made during normal business hours, Monday to Friday, excluding public holidays. The Gallery cannot guarantee an exact delivery date due to delivery volumes and potential changes to delivery routes.

 

If unforeseen circumstances prevent the Gallery from delivering an item within the timeframe described in this Online Shopping Policy, it will contact you to share the reasons for the delay and make arrangements for a new estimated delivery date.

 

Signature required on delivery

The Gallery always chooses the “signature required” option to prevent parcels from being left unattended at their destination. However, the Gallery cannot be held responsible for failure to follow its instructions or unavailability of the “signature required” option in a given region.

 

Package tracking

Once the online order has shipped, Canada Post or the chosen courier will confirm that order has been picked up and has left the Gallery by sending an email to the address provided during the purchase. You can track the package using the tracking number provided in the shipping confirmation.

 

If you are absent during the delivery attempt, the package will be handed over to a third party at the delivery address. If no one is available to take possession of the package, it will be held at the postal outlet (Canada Post) or sent to the nearest drop-off point (Purolator and UPS) for later pick-up or delivery. The shipping service will leave a delivery notice to indicate where and how to pick up your package.

 

Please note that each additional delivery attempt involves additional charges to the sender. While these costs are not charged to you, the Gallery asks that its clients try to avoid additional delivery attempts for economic and package security reasons.

 

Liability for parcels

All items purchased through auptitbonheur.com are subject to a shipping contract, which means that the Gallery assumes full liability for loss of the items ordered as soon as they are handed over to the shipping service. Ownership of these items is transferred to the customer once they take possession of the package at their destination, either at the delivery address provided in the online purchase order or at the courier depot or Canada Post counter, as evidenced by the delivery date.

This will allow the Gallery to begin locating the parcel with the carrier and follow up on the situation.

 

Damage and breakage

The Gallery has more than 30 years of experience in shipping works of art. Its skilled employees do everything possible to ensure that parcels reach their destination in perfect condition. While such situations are extremely rare, items may break in transit despite our precautions. You are responsible for examining your package upon delivery. If you receive a damaged package, you must:

  • Notify the delivery person of the packages's condition and have them sign the delivery slip to that effect; 

  • Clearly photograph the outer packaging and any damage to its contents, then email the photos to info@auptitbonheur.com with a detailed description of the damage within 48 hours of receiving the package.

If you fulfil at least one of these conditions, the damaged piece will either be refunded in full, replaced by a piece of equivalent value or credited for a future online or gallery purchase, at your choice. Disclosure of personal information

The Gallery uses shipping companies and the postal service to provide shipping services. If necessary, we will share our customers’ contact information with these companies for shipping and delivery purposes only. While the chosen suppliers have some of the best privacy policies in the industry, the Gallery cannot be held responsible for any damages resulting from their use of this information.

Returns

If a piece purchased online via auptitbonheur.com does not meet your expectations, you may return it under the following conditions.

 

  • Up to 48 hours after receipt of your order:

- Refund equal to 90% of the total cost of the returned work, including taxes;

- Return of the work in its original box, at the Gallery's expense.

 

  • Between 48 hours and 10 days after receipt of your order:

- Credit on future purchase equal to 90% of the total cost of the returned work, including taxes;

- Return of the work in its original box, at the Gallery's expense.

 

It is your responsibility to contact the Gallery’s bilingual customer service by phone at 1-855-665-2060 (toll-free) or by email at info@auptitbonheur.com to make arrangements before returning a piece. Note: This step is necessary for returns. Once you have contacted customer service, the Gallery will email you an email with a prepaid return label. The piece and its frame (if applicable) must be returned in their original state, in perfect condition, in the original box. The Gallery reserves the right to refuse a refund or credit if these conditions are not met.

 

Once the Gallery receives the piece, your return will be processed within one (1) to five (5) business days. You will receive an email once the return has been processed. If applicable, a credit for future purchases will be issued or a refund will be credited to the original payment method. Note that it may take up to three (3) to five (5) additional business days for your financial institution to process a refund.

 

Exchanges

If a piece purchased online via auptitbonheur.com does not meet your expectations, you may exchange it under the following conditions.

 

  • Up to 10 days after receipt of your order:

- Exchange value equivalent to 100% of the total cost of the work to be exchanged, including taxes;

- We accept exchanges of equal or greater value;

- The work must be returned to the gallery, in its original box and at your expense. We do not accept exchanges by mail or courier.

 

To exchange a piece, you must contact the Gallery’s bilingual customer service by phone at 1-855-665-2060 (toll-free) or by email at info@auptitbonheur.com before coming to the gallery. The piece and its frame (if applicable) must be returned in their original state, in perfect condition, in the original box. The Gallery reserves the right to refuse any exchange if these conditions are not met.

 

Shipping and handling: liability for returns

When returning a work by post or by courier (Purolator or UPS), you must follow the instructions in the Returns section above. By providing you with a prepaid return label, the Gallery assumes liability for loss of the returned items as soon as the package is handed over to Canada Post or the courier. Ownership of the package and its contents is therefore transferred to the Gallery once Canada Post, Purolator or UPS receives the package from you. Should you not follow the instructions in the Returns section above, you will assume liability for loss until the Gallery receives the contents of the package.

 

 

Limitations

 

The Gallery reserves the right to refuse any order placed on its website. If an order is modified or cancelled, the Gallery will attempt to inform you by contacting you using the information provided at the time of purchase.

 

While the suppliers responsible for processing online orders have established security processes, the Gallery reserves the right to suspend or cancel orders that, in its sole opinion, appear to involve an unusual, irregular or questionable transaction at any time. This is done to avoid potential fraud against itself, its clients and its artists.

 

If the item’s price or information (on the website or in the order confirmation) is inaccurate due to an error, the Gallery may, at its sole discretion, reject or cancel an order. Should the Gallery cancel your order due to a pricing error, it will contact you and invite you to place a new order for the item at the corrected price.

If the Gallery is unable to deliver an ordered item because it is no longer available, the Gallery will notify you by email or telephone and the order for the item will be cancelled automatically. Product information and availability

 

While the Gallery aims to provide accurate information on items and prices, mistakes may occur. The Gallery reserves the right to correct errors in item prices or descriptions and change item prices at any time without notice. If the item price or information (on the website or in the order confirmation) is inaccurate due to an error, the Gallery may, at its sole discretion, reject or cancel an order. In the event of an error in pricing, the Gallery will cancel the order in question and then contact you and invite you to place a new order for the item at the corrected price.
